Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Devang Patel, trading as TodayBirthday.in("we", "us", "our"), registered at E-801, Savan Plaza, Yogi Chowk, Surat, Gujarat 395010, India. They govern your access to and use of https://todaybirthday.inand every related feature (the "Service").

By creating an account, adding a website, or making a payment, you confirm that you have read and accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, to buy anything on the Service.

TodayBirthday.in is a directory and celebration platform for website birthdays. Registered users can publish website profiles, record launch dates and milestones, collect public birthday wishes, generate certificates, manage team and founder profiles, and schedule time capsules.

The Service is provided as an informational and community product. We do not verify the accuracy of dates, ownership claims, or any other content supplied by users, except where a listing is explicitly marked as verified by us.

You are responsible for the accuracy of the information on your account, for keeping your login credentials confidential, and for all activity that happens under your account. Tell us immediately at devangfour@gmail.com if you suspect unauthorised access.

One person or organisation may hold one account. Sharing credentials with third parties, or reselling access to the Service, is not permitted.

Every paid item on the Service is a one-time charge. There is no subscription and nothing renews automatically.

• Your account includes 1 free website slot. This never expires and never costs anything.
• Each additional website requires a paid website slot, charged once at the price shown on our Pricing page and on the Stripe checkout page before you confirm.
• Purchased slots are permanent. They are not time-limited and are not tied to a specific website — removing a website releases its slot for reuse.
• Prices are displayed exclusive of tax. Any applicable tax is calculated and shown by Stripe at checkout.

Payments are processed by Stripe, Inc. and its regional affiliates. We do not receive, process, or store your full card number, CVV, or equivalent payment credentials. Your use of checkout is also subject to Stripe's own terms and privacy notice.

A purchase is complete only when Stripe confirms the payment as successful. If a payment is declined, reversed, or charged back, the associated slots may be withdrawn and any websites published using them may be unpublished.

We may change prices at any time. A price change never affects a purchase you have already completed.

There is no subscription on the Service and therefore nothing to cancel. Every payment is a single one-time charge for a website slot. No recurring mandate, standing instruction, or auto-debit is ever created against your card, and no renewal charge will ever be raised.

You may stop using the Service at any time. Deleting your account from dashboard settings removes your listings and ends the relationship immediately, at no charge and with no cancellation fee.

A purchase may be cancelled by you at any point before payment is confirmed simply by closing the Stripe checkout page. No charge is captured and no slots are credited.

We refund a website slot in full when you request it within 14 days of payment and the slot is unused — that is, no website is currently published against it.

We also refund in full, regardless of the 14-day window, if you were charged more than once for the same purchase, charged an amount other than the one shown at checkout, or if a payment succeeded but the slots were never credited to your account.

Refunds are not ordinarily available where the slot is in active use beyond the 14-day window, or where the account was terminated for breaching these Terms. Nothing in this section limits any refund right you have under applicable Indian consumer law.

To request a refund, email devangfour@gmail.com with the email address used at checkout and the payment date. We acknowledge every request within 48 hours, submit approved refunds to Stripe within 2 business days, and the money reaches your original payment method typically within 5 to 10 business days thereafter.

You keep ownership of everything you submit — website details, logos, screenshots, descriptions, wishes, stories, and time capsule entries ("Your Content"). By submitting it, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, and display Your Content for the purpose of operating and promoting the Service.

You confirm that you have the right to submit Your Content, and you agree not to:

• claim ownership of, or publish details about, a website or brand you do not represent;
• upload content that is unlawful, defamatory, obscene, hateful, harassing, or infringes anyone's intellectual property or privacy;
• post spam, bulk promotional material, malware, or misleading links;
• scrape, crawl, or bulk-download the Service beyond what our robots.txt permits, or attempt to interfere with its security or availability;
• use the Service to impersonate any person or organisation, or to misrepresent your affiliation with one.

We may moderate, edit, unpublish, or delete any content that breaches these Terms, and may suspend or terminate accounts that repeatedly do so — with or without notice where the breach is serious.

The Service itself — its software, design, layout, text, graphics, and the TodayBirthday.in name and logo — belongs to us or our licensors and is protected by intellectual property law. Nothing in these Terms transfers those rights to you. Third-party names, logos, and screenshots displayed on listing pages remain the property of their respective owners and are shown for identification purposes.

If a listing infringes your rights or misrepresents your website, email devangfour@gmail.com with the listing URL, a description of the issue, and proof of your ownership or authority. We aim to acknowledge takedown requests within 48 hours and to act on valid ones promptly.

We work to keep the Service available but do not guarantee uninterrupted or error-free operation. We may add, change, suspend, or discontinue any feature at any time. If we discontinue a paid feature entirely, we will give reasonable notice and offer a pro-rata refund where fair to do so.

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement. Website ages, birthdays, milestones, certificates, and rankings are generated from user-supplied and publicly available data and are provided for informational and celebratory purposes only.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising from your use of the Service. Our total aggregate liability for any claim relating to the Service is limited to the greater of the total amount you paid us in the twelve months before the claim arose, or the equivalent of USD 50. Nothing here excludes liability that cannot lawfully be excluded.

You agree to indemnify and hold us harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms or of any law or third-party right.

You may stop using the Service and delete your account at any time from your dashboard settings. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service and its users. On termination, your listings are unpublished. Termination does not automatically entitle you to a refund; see the Cancellation & Refund Policy.

These Terms are governed by the laws of India. The courts of Surat, Gujarat, India have exclusive jurisdiction over any dispute arising from them, except that either party may seek injunctive relief in any competent court. Before starting formal proceedings, please contact us at devangfour@gmail.com so we can try to resolve the issue directly.

We may update these Terms as the Service evolves or the law changes. The revision date at the top of this page always reflects the current version, and material changes will be announced on the Service or by email. Continuing to use the Service after a change takes effect means you accept the updated Terms.
